TOUS LES JOURS REWARDS PROGRAM TERMS AND CONDITIONS
By registering to become a member (a “Member” or “you” or “your”) of Tous Les Jours® Tous Les Jours Rewards (“TLJ Fresh Rewards” or the “Program”) and by participating in the Program, you (i) represent that you are 18 years of age or older and (ii) agree to the following Program Terms and Conditions (these “Terms”). TLJ Fresh Rewardsis operated by SEHFoodSdn Bhd. (“SEHF”), the authorized licensee and distributor ofTous Les Jours products in Malaysia (“Tous Les Jours”).
1. TLJ FRESH REWARDSOVERVIEW
When you join TLJ Fresh Rewards, you will be able to earn points on your purchases made at participating Tous Les Jours retail stores operated by SEHF in Malaysia(“Tous Les JoursRetail Stores”). You may also earn points by participating in certain special activities announced by SEHF from time to time. For every MYR that you spend in Tous Les Jours Retail Stores in Malaysia, you will receive one point if you are a Member. Points can be accumulated in 12 months and redeemed at Tous Les Jours Retail Stores with the overall discount up to 10% of the original price (including coupon). As a TLJ Fresh Rewardsmember, you will gain access to exclusive seasonal promotions and gift redemptions, if any
2. MEMBERSHIP
A. ELIGIBILITY: You must be at least 18 years of age to become a member. SEHF employees and/or its affiliate entities (collectively “SEHF Group”) are not eligible to participate in this Program and shall not apply for membership.

If a SEHF Group employee applies for or becomes a member, SEHF can reject/terminate the membership without prior notice. Any benefits, privileges, or entitlements received under the Program, including accrued points, will be forfeited and considered null and void upon termination.
If a Member starts working for SEHF Group, their membership will be automatically suspended without notice when their employment begins. The Member must and is responsible for proactively consulting with SEHF to understand any changes to their benefits, privileges, or entitlements, including forfeiture of accrued points, before starting employment. SEHF is not responsible for any consequences, such as the loss of membership benefits, privileges, or entitlements, resulting from the suspension of membership due to employment with SEHF.
B. HOW TO JOIN: Scan the TLJ Fresh RewardsQR code at any Tous Les Jours Retail Stores in Malaysia and register to become a TLJ Fresh Rewardsmember. Once you complete your registration, you will receive a welcome coupon. Come and gain access to the most exclusivesweet loyalty program!
C. ACCESSING POINTS INFORMATION: You may access information on yourTLJ Fresh Rewards account at any of Tous Les Jours Retail Stores. Ask any sales associate for more information.
D. UPDATING INFORMATION: You are responsible for providing the correct phone number, email address and contact information to receive points and to ensure receipt of points. As a result, each Member is responsible for maintaining accurate and updated personal information, including your phone number and email address. You may update your personal information at any of Tous Les Jours Retail Stores.
3. EARNING POINTS
A. Points can be earned all year at any of the participating Tous Les Jours Retail Stores.
B. When you shop at Tous Les JoursRetail Stores, you receive one (1) Point for every MYR 1 spent on any eligible product that you purchase (a “Qualifying Purchase,” as further described below). The points will be added to your TLJ Fresh Rewardsaccount when you provide your email address or phone number used to become a Member at the time of purchase.
C. Qualifying Purchases include regular and sale-priced merchandise in Tous Les Jours Retail Stores. Sample sale items are excluded fromTLJ Fresh Rewards, and points are not earned for purchases of such items.
D. Points may also be earned for participation in certain activities designated and announced by SEHF during the points year. Example activities could include connecting with SEHF on social media and participating in Tous Les Jours offline events. Members may also be able to earn bonus points for making purchases of designated products or during a designated time, as determined and announced by SEHF. SEHF reserves the right to make bonus points and other promotional offers available to select Members based on purchase activity, geographic location, Program participation, and/or information supplied by the Member. SEHF reserves the right to add, withdraw, amend, or otherwise change bonus opportunities at any time at its sole discretion, with or without notice to Members.
E. The points you have earned through a purchase (including bonus points for designated products, if applicable) by providing your phone or email address at the time of purchase will be netted from your overall points total if the item is returned. Negative point balances never expire. Points have no cash value. You cannot give or transfer your points to anyone else.
4. POINTS EARNED
A. Points earned are valid for redemption for a period of 12 months from the date of issuance. After this period, any unused points will expire, and participants will need to earn new points for future redemption.
B. The points can be accumulated and redeemed at any Tous Les JoursRetail Stores in Malaysia at with the overall discount is up to 10% of the original price (including the coupon).
C. TLJ Fresh Rewards Members may also have early access to special events and be invited to participate in exclusive experiences for TLJ Fresh RewardsMembers.
5. PHONE, EMAIL AND PRIVACY
By registering for the Program, you agree to receive transactional messages, promotional offers, and updates from the TLJ Fresh Rewardsand SEHF. As a benefit and condition of enrolment in or registration for the Program, Members will be sent, by sms/email, information about Program Points and vouchers, Program updates, and other related materials at the discretion of SEHF. Members may not unsubscribe from transactional sms/emails of the Program but may cancel their membership in the Program as described below in the General Terms. Members may unsubscribe from Tous Les Jours promotional emails at any time via the “Unsubscribe” link in those emails.
6. GENERAL TERMS OF THE TLJ FRESH REWARDSPROGRAM
A. Membership in theTLJ Fresh Rewardsand its benefits, privileges, or entitlements are offered at the discretion of SEHF, which SEHF, at its sole discretion, reserves the right to terminate, suspend, change, limit, modify, and/or cancel any Program rules, regulations, benefits, or conditions of participation from time to time including the mechanism for points earning and redemption. SEHF shall not be held liable for such termination, suspension, changes, limitation, modification, and/or cancelation made to TLJ Fresh Rewards.
B. If SEHF changes or modifies these Terms, SEHF may provide notice of any changes through these Terms via sms, email, and/or other communication methods/channels to TLJ Fresh Rewardsmembers. However, SEHF may also implement changes or modifications without prior notice. It is the responsibility of Members to periodically review the most up-to-date Terms, which are available at stores and/or SEHF’s designated website. For most current information and clarity, Members are encouraged to consult the sales store or contact the SEHF customer service team. Electing to remain a Member of the TLJ Fresh Rewardsafter a change in the Terms constitutes your acceptance of the revised Terms. The revisions to the TLJ Fresh Rewardsthat SEHF may make include any of the following changes: (i) increase or decrease of the number of points earned on a Qualifying Purchase; (ii) increase the number of points in relation to MYR instore cash value; (iii) change the method of becoming a Member; (v) institute or add blackout dates for earning points.
C. These Terms are void where and to the extent prohibited by law.
D. In the event of a dispute over ownership of a TLJ Fresh Rewardsaccount, the registration will be declared to have been made by the authorized account holder of the phone number/email address submitted at the time of registration. For purposes of these Terms, the “authorized account holder” is the natural person who is assigned to the submitted phone number/email address by a phone service provider, an internet provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
E. Abuse of the Program, including failure to abide by these Terms, the sale or barter (or the attempted sale or barter) of points, or promotional offers, and any misrepresentation of fact relating thereto or other improper conduct, including fraud or suspicious, as determined by SEHF in its sole judgment may result in cancellation of a Member’s account and future disqualification from Program participation, forfeiture of all points accrued, and/or cancellation of previously issued but unused vouchers. At our discretion, we may prosecute abuse of the Program to the fullest extent of the law.
F. You may cancel your TLJ Fresh Rewardsmembership at any of Tous Les Jours Retail Stores. If you cancel yourTLJ Fresh Rewardsmembership, any membership benefits, privileges, or entitlements received or accrued under the TLJ Fresh Rewardsprior to or following such cancellation (including accrued points) shall be forfeited and deemed null and void.
G. Points are not transferable and may not be combined among Members or conveyed by any means to anyone, including through a Member’s estate, and may not be passed to a Member’s successors and assigns. Accrued points do not constitute a property of the Member. Accrued points are not transferable by the Member upon death, as part of a domestic relations matter, or otherwise.
H. By agreeing to participate in the TLJ Fresh Rewards, you release SEHF, its parent and subsidiaries and affiliate entities, and their respective directors, officers, employees, and agents (the “Released Parties”) from all liability with respect to the termination ofTLJ Fresh Rewardsfor any reason, misdirection or misuse of any points, or the use of any points by an individual other than TLJ Fresh RewardsMember who earned the points. You further agree through your agreement to participate in the Program to release the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) in connection with your participation in the TLJ Fresh Rewards, use of products or experiences from the TLJ Fresh Rewards, or agreement to these Terms.
I. The Released Parties make no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to TLJ Fresh Rewards, membership in TLJ Fresh Rewards, or any products or services related to TLJ Fresh Rewards.
J. If SEHF is no longer or ceases to be the authorized licensee and distributor of Tous Les Jours products in Malaysia, SEHF reserves the right to terminate the Program with immediate effect. Upon termination, all membership benefits, privileges, or entitlements received or accrued by Members associated with the TLJ Fresh Rewardswill be forfeited and will not be redeemable in cash or any other form of compensation.
K. The TLJ Fresh Rewardsand these Terms will be governed by and construed under the laws of Malaysia without reference to conflict-of-laws considerations. Any claims must be raised and resolved in the courts of Malaysia.
L. Tous Les Jours logo, TLJ Fresh Rewardslogo, and other logos and taglines are the intellectual property of Tous Les Jours.
